1. What Personal Information Do We Collect?

Content Posted Online. For influencers and similar persons that Avenco considers for partnerships, Avenco may collect or use any information posted or disclosed on publicly accessible third-party message boards, chat, profile pages, blogs, and other services, including through social media outlets, to assess such opportunities.

We do not knowingly collect protected classifications about our users, biometric information, or education-related information. When communicating with us by email or through forms on our Services, or when you publicly share content through our Services, we ask that you please do not send us any sensitive information pertaining to yourself or to others.

 

2. How Do We Use Personal Information?

We use your personal information for the purposes described in this Privacy Policy or otherwise disclosed to you, primarily relating to providing products and services to you and improving our Services. The purposes and types of information we process are listed in the chart below and should be understood to include uses of your personal data that are compatible with the purposes listed.

· Location data (inferred from your IP address) to tailor your experience in terms of displaying the appropriate local website, language, or user experience.

· Additional identity information that you provide if you take part in our "college campus ambassador program," such as your school, name, email address, PayPal account, and city, for identity authentication purposes.

To provide customer service and support

· Your communication history with us via various channels, such as email, phone, social media, mail, instant chat, and our customer service platform, to respond to your requests, as well as to keep you updated about your account and the Services.

To provide product and seller feedback

· Photographs, customer reviews, and other feedback you upload to our Services in accordance with our Terms and Conditions, to provide product advice and to allow you to voluntarily show other potential customers what items may look like when worn or to relate experiences with sellers on our Services.

To undertake marketing, advertising or other promotional activities

· Basic Personal Identifiers and contact information, such as phone number and email address, for telemarketing and email marketing purposes.

· Non-directly identifiable device identifiers, operating system information, and cookie information, to direct and measure the effectiveness of the advertising we offer.

· Data about how you engage with our Services, such as browsing, adding to your shopping cart, saving items, placing an order, and returns) for market research, statistical analysis, and the display of personalized advertising based on your activity on our site and inferred interests.

· Basic Personal Identifiers and contact information, such as name, email address, and phone number, when you voluntarily enter a competition, market survey, event, or other marketing campaigns organized by us.

· Device/Online Identifiers and Network Activity for fault analysis, troubleshooting, and system maintenance, as well as setting default options for you, such as language and currency.

· Preferences, Behavior Data, and Inferences, including collection of your "like" records and votes when prompted as to your preference between two items, used by us to recommend clothing sizes or styles, personalization, or to provide fit prediction services for you.

· Commercial Information to share within and across our corporate organization for our business administration and improvement needs.

· Interview records, user profile for client service optimization, e.g. client interview, profile analysis, personalized advertising.

To prevent and investigate fraud and other illegal activities

· Device/Online Identifiers and Network Activity, such as browser type, device information, operating system, and account setting information are processed for fraud prevention and detection and credit risk reduction.

· Basic Personal Identifiers (ex: log-in data) are used for risk control and fraud reporting.

· Billing address is processed to verify payment information.

To comply with legal or compliance requirements

· Identity information, such as ID- or passport-related information, for customs clearance purposes.

· Commercial Information and certain identifying information to handle and resolve legal disputes, for regulatory investigations purposes, and to comply with lawful requests from a competent law enforcement agency or court.

Other Consent-Based Purposes

· We may use your personal information for a new or secondary purpose if disclosed to you prior to you providing us your personal information or which is reasonably necessary to provide the Services or other related products and/or services requested, with your consent or upon your direction.

3. When Do We Share Personal Data?

We may disclose and share your personal information with the parties as described below.

· A.Within Our Corporate Organization .  Avenco is a corporate organization that has a network of legal entities, business processes, management structures, and technical systems. Where permitted by applicable law, we may share your personal information with our related group companies and, in some cases, other affiliates of our corporate group to provide you with Services, administer our business, provide you with a personalized user experience, or to take actions based on your orders, requests, or preferences.

· B.Third Party Sellers . When you order products from a third-party seller on our Services and the seller will ship the products to you directly, we may share your Basic Personal Identifiers (name, address, and telephone number) or order relevant information (purchase item, payment account) with them so that they may fulfill your order and provide your personal data to a shipping logistics provider in order to perform the contract and ship the products to you.

· We strive to ensure that our third-party service providers can only use your data for the purposes for which it was provided to them and to the extent necessary for such purposes, in accordance with our written instructions.

· D.To Maintain Legal and Regulatory Compliance . We have the right to disclose your personal information as required by law, or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, request from a regulator or any other legal process served on us. We also may disclose your information where we reasonably believe that the disclosure is necessary to enforce our agreements or policies, or if we believe that disclosure will help us protect the rights, property, or safety of Avenco or our customers.

· E.Co-Branded Services and Features Portions of our Services may be offered as part of co-branded services and features. We will share your personal information with our co-branded partners based on your voluntary use of or participation in a co-branded service or feature. The co-branded partners will be identified on the co-branded feature or service, along with an applicable co-branded partner's privacy policy. Use of your personal information by a co-branded partner will be subject to a co-branded partner’s privacy policy. If you wish to opt-out of a co-branded partner’s future use of your personal information, you will need to contact the co-branded partner directly.

· F.Consent . We may disclose your personal information for any purpose with your consent.

· G.Corporate Transactions . We may disclose personal information—including account information, Wallet balance or points information—to a buyer, prospective buyer, corporate affiliate, or other successors in the event of a merger, divestiture, restructuring, reorganization, dissolution, or sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which personal information held by us about our Services users is among the assets transferred. You acknowledge and agree to our assignment or transfer of rights to your personal information.

4. How Does Avenco Secure Your Personal Information?

We maintain reasonable physical, electronic, and procedural safeguards designed to guard your personal data from unauthorized processing, use or disclosure. Our security measures include industry-standard physical, technical, and administrative measures to prevent unauthorized access to or disclosure of your information. We also require our service providers to provide privacy and security controls to protect data shared with them in order to perform services.

The Internet is not an absolutely secure environment, and we cannot guarantee that your personal data will be secure. We therefore strongly recommend that you use a unique, complex password to help us ensure the security of your account. We also strongly recommend that you do not share your password with others or re-use passwords on our Services that you use on other sites or apps, as doing so increases the likelihood of your being the victim of a credential stuffing attack or other malicious cyber behavior. If you feel that the security of your account or personal data has been compromised, please immediately contact us at the method as described in the "Contact Us" section below.


5. What Are Your Privacy Rights and How to Exercise Them?

Depending on where you live, residents of certain states (including but not limited to California, Colorado, Connecticut, Delaware, Iowa, Montana, Nevada, New Hampshire, New Jersey, Nebraska, Oregon, Texas, Utah, Virginia, and Washington) may have privacy rights relating to their personal information which are described below. In addition to these covered individuals, Avenco has chosen to extend these same privacy options to all US customers, so that any Avenco customer in the US can exercise the privacy choices described in this Section.

5.1 Access, Correction, and Deletion of your Personal Information Depending on where you live, you may have the right to access, correct, or delete the personal information that we collect. However, your rights are subject to certain exceptions according to the applicable law. For instance, we cannot disclose specific pieces of personal information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the personal information, your account with us or the security of our network systems.

·  Right to Know/Access/Portability - If you want to access the information we collected or disclosed about you, the business purposes involved and the sources of such information, you can request to receive a copy of your personal data in a structured and machine-readable format. You can submit an access request by sending us an email at [support@avencohome.com] (provide your full name, email address (linked to your account or for verification), and the nature of your request).

· Right to Correction/Rectification - If you believe that we have incorrect or incomplete information about you,you can submit a correction request by either completing the request form by sending us an email at [support@avencohome.com]  (provide your full name, email address linked to your account, and the nature of your request).

· Right to be Forgotten/Deletion - You can request that we permanently erase your personal information from our records by sending us an email at [support@avencohome.com]. If you request that your personal data be deleted, you will not be able to login again and any associated information will be deleted. This will include any Avenco Wallet Credits, coupon codes, points, VIP status, address book entries, and other information associated with your customer profile. However, please note that per Avenco Privacy Policy some data may be retained to the extent it is permitted by applicable law and/or is necessary to comply with our legal obligations (for example, we may retain your order history information to satisfy legally required financial reporting obligations), resolve disputes, or enforce our legal agreements and policies. In addition, deletion of your data may limit our ability to confirm your purchases and thereby prevent us from providing customer support. Also, if you have currently pending orders, fulfillment of your deletion request may be delayed until all pending orders are delivered. If you want to shop at Avenco in the future, you’ll need to set up a new account.

5.2 Right to Opt Out of “Sale”/Sharing/Targeted Advertising - We do not sell our users’ information to third parties as that term is generally understood. However, making certain identifiers available to third parties may be considered a “sale” or “sharing” under certain laws. When you visit our website, we may share some personal identifiers such as cookies and other tracking technologies for analytics and to personalize your experience with targeted ads as described herein. In the previous 12 months, we may have shared identifiers and inferences about you with our partners, third parties, and affiliates in such a way that, under such privacy laws, may be interpreted as “selling” or “sharing”. Please see the "Cookies and Other Tracking Technologies" section above for a description of opting out of cookies and controlling browser settings. If you would like to opt-out of the “sale”/”sharing” of such personal information, targeted advertising, or marketing profiles, you can control such access to your data by clicking the “Do Not Sell or Share My Personal Information”/ “Manage Cookies” link on the bottom of the webpage, or in the Settings menu in your mobile app.

5.3 Unsubscribe from Our Marketing Communications - If you do not want us to use your email account to send you marketing emails or non-transactional promotional materials, please directly click on the unsubscribe link at the bottom of any of our marketing email messages to you or contact us by sending us an email at [support@avencohome.com] . If you previously consented to receive text messages (SMS) and mobile notifications, you can reply “STOP” to any SMS (text) message to cancel or contact us by sending us an email at [support@avencohome.com] . If you wish to stop push notifications or alerts to your mobile device through our app, you can stop these notifications by changing the settings on your mobile device.

5.4 Objection to Processing/Unauthorized Account Creation (Unbind) - If someone has created a Avenco account using your email address without your authorization, you can "unbind" the account from your email address. To process this request, please submit a request by sending us an email at [support@avencohome.com] .

5.5 Requests from Authorized Agents/Third Parties- – For the protection of your account and the security of your data, only you or a person you formally authorize to act on your behalf may make a privacy request related to your personal information. If you use an authorized agent to submit such a request, we will require written proof that the authorized agent has been authorized to act on your behalf, which we obtain in the request verification process. Third parties may submit requests on a data subject's behalf; however, requests will still need to be directed to the data subject themselves for verification and authorization to proceed.

5.6 Right Against Discrimination - You have the right not to be discriminated against for exercising any of the rights described in this section. We will not discriminate against you for exercising any of the rights described herein.

5.7 Account Verification - Avenco is legally obligated to verify the identity of a requester to ensure that personal information from your account can only be accessed and released to duly authorized parties. To verify your request, we will send a verification email to the e-mail address you provide. Once you click the verification link, we will be able to proceed with processing the request based on the verified email address. However, if your account is associated with an email address other than the one provided for verification, we will be unable to fulfill your request and will require you to resubmit your request using your email address associated with your account. We may not accommodate a data subject request if we believe the change would violate any legal requirement or pose an unacceptable risk to the privacy or security of our customers.

5.8 Lodging Complaints.- If you believe we have infringed or violated your privacy rights, please contact us by sending us an email at [support@avencohome.com] so that we may attempt to resolve any issues to your satisfaction.

5.9 Appeal – If you would like to appeal any decision made by the company relative to your privacy rights, please directly reply to the correspondence received from the company relating to the decision.

5.10 Automated Decision-Making - Some states grant rights to request that businesses not engage in certain types of automated decision making about you. Because Avenco does not use automated decision making that is subject to this right, we do not accept requests to opt out of automated decision making.

 

6. Additional Privacy Matters

6.1 Third Party Websites - Our Services may contain links to third-party sites. This Policy does not apply to those third-party sites. We recommend that you read the privacy statements of any other sites that you visit as we are not responsible for the privacy practices of those sites.

6.2 Children’s Data - If a minor has provided us with personal information without parental or guardian consent, the parent or guardian should contact us immediately to remove the relevant personal information and unsubscribe the minor. As described further in our Terms and Conditions , please do not upload photographs showing other people, in particular if they are minors.

6.3 Transfers of Your Personal Data Outside the US - This Privacy Policy only applies to residents of the United States. If you are a resident of another country, please see the applicable Avenco Privacy Policy that is specific to your jurisdiction, which is generally available on the local version Site. Please note as well that when you use our Services, your personal data may be accessed or transferred outside of the United States, such as when you order products from a seller located in another country and your Basic Personal Identifiers are sent to them in order to fulfill your order. For some sellers located in the US, they may also maintain business operations outside the US and need to transfer data to other countries in order to fulfill orders. Such countries may have data protection laws that are less protective than the laws of the jurisdiction in which you reside. For these transfers, we rely on appropriate safeguards as permitted under applicable law and standards. If you do not want your information transferred to, processed, accessed, or maintained outside of the United States, please understand that you may not be able to order products from the Services.

 

7. Additional State-Specific Privacy Rights and Notices

In addition to the rights described in “What Are Your Privacy Rights and How to Exercise Them?” above, the following rights and notices apply to residents of the states listed below.

7.1 California - California's Shine The Light law permits customers who are residents of California to request information regarding our disclosure of certain personal information to third parties for their own direct marketing purposes (see California Civil Code section 1798.83 (e)(7) for a list of personal data categories). You can submit a disclosure request using the contact information provided below once a year and free of charge. However, we do not share any personal information protected under the Shine The Light law with third parties, other corporate family entities, or affiliate businesses for their direct marketing purposes.

7.2 Nevada - Although we do not "sell" "covered information" of Nevada "consumers" as those terms are defined by Chapter 603A of the Nevada Revised Statutes, if you are a Nevada consumer, please sending us an email at [support@avencohome.com]  and inform us that you would like us to provide you notice in the event we should do so in the future, at which point you will have an opportunity to be verified and exercise your opt-out rights under that law. You may contact us as described below. It is your responsibility to keep your notice contact information current.

7.3 Oregon - Upon reasonable request by sending us an email at [support@avencohome.com]  and verification that you are a resident of the State of Oregon, we will provide you with a list of specific “third parties” (as such term is defined per ORS 646A.570(20)), other than natural persons, to whom Avenco has disclosed personal information relating to Oregon consumers, excluding consumers, controllers, processors, or affiliates of Avenco or its processors and except where such disclosure would require disclosure of Avenco's trade secrets, as defined in ORS 646.461.
